By accessing or using www.lexafricana.com (the "Site") or subscribing to our briefing, you agree to be bound by these Terms of Service. If you do not agree, please do not use the Site or our services.
You may use the Site for lawful purposes only. You agree not to use the Site in any way that violates applicable laws or regulations, infringes on the rights of others, or interferes with the operation of the Site.
The content published by Lex Africana — including the monthly briefing, articles, and any commentary on legal, regulatory, or jurisdictional matters — is provided for informational and strategic purposes only. It does not constitute legal advice and should not be relied upon as a substitute for consultation with a qualified attorney admitted in the relevant jurisdiction. No attorney-client relationship is formed by your use of the Site, your subscription, or any communication with us.
Lex Africana offers individual licenses and group licenses (Practice, Department, Firm, and Firm-wide). Subscription fees are stated on the pricing page, exclusive of applicable taxes (HT). Multi-year licenses, unlimited seats, multi-office access, and bespoke institutional terms are available on request. Specific access conditions are available for African public institutions, state-owned mining companies, regulators, and arbitration centres.
Subscriptions are billed annually in advance through our payment processor. A paid invoice is provided upon confirmation of payment. Inaugural pricing, where offered, is guaranteed for two years from the date of subscription. After that period, renewal pricing may be adjusted; we will provide notice of any changes in advance of renewal.
Subject to payment of applicable fees, we grant you a non-exclusive, non-transferable license to access and use the briefing as follows:
Group licenses permit internal circulation within the subscribing organization, up to the number of authorized users specified in the chosen plan, and use of the briefing to inform client work, transactions, or investment activity.
Individual licenses are for personal, professional use by a single named user and may not be shared.
Except as expressly permitted, you may not redistribute, resell, republish, or post the briefing publicly, nor use it to create derivative commercial products. Unauthorized sharing may result in termination of your subscription without refund.
To access certain features, you must register an account and provide accurate, current information. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Please notify us promptly at contact@lexafricana.com of any unauthorized access.
Subscriptions are intended for professional use. Where applicable consumer protection law grants a right of withdrawal, that right may be limited or waived once digital content (such as a briefing edition) has been delivered. Outside any statutory withdrawal period, subscription fees are non-refundable except where required by law or expressly agreed in writing.
All content published by Lex Africana — including the monthly briefing, articles, analyses, data, graphics, logos, and the forthcoming Lex Africana data platform — is the property of Ilini and its contributors and is protected by applicable copyright and intellectual property laws. Your subscription grants you a license to use the content as set out in Section 5; it does not transfer any ownership rights.
Subscribers may receive invitations to Lex Africana events, including closed-door sessions, and early access to the Lex Africana data platform upon its release. Attendance at events and use of the platform are subject to additional terms communicated at the time of the invitation or release.
The Site may contain links to third-party websites and rely on third-party providers (including for payment processing). We are not responsible for the content, accuracy, or practices of any third-party sites or services and do not endorse them.
The Site and the briefing are provided "as is" and "as available" without warranties of any kind, whether express or implied. While we take care to ensure the accuracy and timeliness of our analysis, we do not guarantee that the content is complete, error-free, or suitable for any particular purpose, nor that the Site will be uninterrupted or free of harmful components.
To the fullest extent permitted by law, Ilini, Lex Africana, and their contributors shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use of, or reliance on, the Site, the briefing, or any related service, including any decisions made on the basis of our analysis.
We may suspend or terminate your access to the Site or your subscription if you breach these Terms, including unauthorized sharing of the briefing. You may cancel your subscription at any time; cancellation takes effect at the end of the current paid period and does not entitle you to a refund of fees already paid, except as set out in Section 7.
We may update these Terms from time to time. Material changes will be communicated to subscribers in advance. Continued use of the Site or the service after changes take effect constitutes your acceptance of the revised Terms.
These Terms are governed by French law. Any dispute arising in connection with the Site or your subscription shall be submitted to the competent courts of Paris, France, subject to any mandatory consumer protection rules that may apply.
These Terms of Service apply to general use of the Site. Subscription purchases are also governed by our General Terms and Conditions of Sale (CGV). In the event of any conflict between these Terms and the CGV with respect to a subscription, the CGV shall prevail.
